These Terms of Service are a binding contract governing access to and use of the Service.

Agreement; acceptance

These Terms of Service ("Terms") are a legally binding agreement between you ("Customer", "you") and the service provider ("Company", "we") governing your access to and use of the AI Safety Gate platform, websites, APIs, SDKs, and related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

Acceptable use; Customer responsibilities

You are solely responsible for (a) all use of the Service under your account, (b) your configurations, policies, prompts, integrations, workflows, automations, and downstream actions and effects, and (c) ensuring that your use of the Service complies with all applicable laws, regulations, contractual obligations, and industry requirements.

  • Do not access or use the Service for unlawful, harmful, deceptive, or infringing activities.
  • Do not submit, process, or transmit data unless you have all rights and authorizations required to do so.
  • Do not attempt to bypass, disable, compromise, or interfere with the Service or security controls.
  • Do not use the Service in a manner that creates a risk of harm to others or to systems of record.
Tool-only disclaimer; no guarantees

The Service is a configurable tool intended to assist with workflow decisioning. The Service does not provide legal, compliance, regulatory, safety, security, or enforcement guarantees. You are solely responsible for determining whether the Service is suitable for your use case and for validating, testing, monitoring, and supervising your workflows in production.

Approval is not guaranteed. A `WARN` decision may remain unapproved, expire, or be rejected, and approval delays do not create any entitlement to refunds or credits.

Human approval authorizes execution for a specific decision_id and does not modify policies or change the original decision record.

Service availability, accuracy, outcomes, and decision quality are not guaranteed. The Service may produce incorrect or incomplete outputs and may be impacted by outages, latency, third-party dependencies, configuration errors, or misuse.

  • You are responsible for selecting what to protect and for defining appropriate policies and thresholds.
  • You are responsible for how your systems handle all outcomes, including PASS, WARN, and BLOCK.
  • You are responsible for any downstream actions triggered by your integrations, workflows, or automations.
Disclaimer of warranties

The service is provided on an “as is” and “as available” basis. We do not make warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, or meet your requirements.

Limitation of liability

To the maximum extent permitted by law, AI Safety Gate and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to the Company for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

Indemnification

You will defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your use of the Service, (b) your data, content, configurations, policies, prompts, integrations, workflows, automations, or downstream actions, or (c) your violation of these Terms or applicable law.

Suspension; termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, in our sole discretion, including if we believe your use may create risk to the Company, the Service, other customers, or third parties, or if you violate these Terms.

Binding arbitration; class-action waiver

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding arbitration on an individual basis, and not in court.

You and the Company waive any right to participate in a class action, class arbitration, or representative proceeding.

Governing law; venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. To the extent any dispute is permitted to be brought in court, you agree to exclusive jurisdiction and venue in the state or federal courts located in Delaware.

Refunds; changes

Refund eligibility and dispute handling are governed by the Refund Policy. We may update the Service and these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
